1. Acceptance of Terms

By downloading, installing, or using the HYX Hybrid Fitness application and website (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Services.

2. Description of Services

HYX provides a fitness tracking application designed for hybrid athletes, offering workout logging, muscle strain analysis, recovery scoring, AI coaching, and related features. The Services are available free of charge with optional paid subscriptions.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate information when creating an account. You may not transfer your account to another person.

4. Subscriptions and Payments

HYX offers optional Pro subscriptions billed monthly ($6.99/month) or annually ($29.99/year). Subscriptions are processed through the Apple App Store. All subscription management, including cancellations, must be done through your Apple ID account settings. Refunds are subject to Apple's refund policies.

Subscription fees may change with 30 days' notice. Continued use after a price change constitutes acceptance of the new price.

5. Acceptable Use

You agree not to:

• Use the Services for any unlawful purpose
• Attempt to reverse engineer or decompile the app
• Interfere with or disrupt the Services
• Share your account with others
• Use automated tools to access the Services

6. Health Disclaimer

Important: HYX provides fitness tracking and general wellness information only. It is not a medical device and does not provide medical advice. Always consult a qualified healthcare provider before beginning any exercise program. HYX is not responsible for any injuries or health consequences resulting from use of the app.

7. Intellectual Property

All content, features, and functionality of the Services are owned by HYX Hybrid Fitness and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute our content without prior written permission.

8. Limitation of Liability

To the maximum extent permitted by law, HYX Hybrid Fitness shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Our total liability is limited to the amount paid by you in the 12 months preceding the claim.

9. Termination

We may terminate or suspend your access to the Services at any time for violations of these Terms. You may delete your account at any time by contacting us at support@hyxpro.com.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via the app or email. Continued use of the Services constitutes acceptance of the updated Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes shall be resolved through binding arbitration.
